I. PROMOTION PERIOD: The “Ultimate Business Greeting Card Sweepstakes” (the “Sweepstakes”) begins 12:01 a.m. Eastern Standard Time ("EST"), Monday, January 1, 2009, and ends 11:59 p.m. Eastern Daylight Time (“EDT”), Wednesday, November 25, 2009 (the "Promotion Period"). Sweepstakes is sponsored by 3D Paper Greetings/3D Paper Graphics, a division of Dimensional Communications Inc., 6 Main Street, Chester, CT 06412 (the “Sponsor”).
II. ELIGIBLITY: This Sweepstakes is open only to a business or a business owner (“Participant”) who is the Sponsor’s existing or a potential customer. The Participant must be 18 years of age or older as of “Sweepstakes Start Date”, and a resident of the forty-eight (48) contiguous states of the U.S. or the District of Columbia, who is physically located and residing therein (excluding Alaska, Hawaii). Officers, directors and employees, prize suppliers, administrators and each of their respective parent, subsidiary and affiliated companies, distributors, advertising, promotional and judging agencies, persons engaged in the development, production or distribution of materials for this Promotion (collectively, the "Released Parties") and the immediate family members (parent, child, sibling, and spouse) of, or persons living in the same household as, such individuals (whether related or not) are not eligible to participate in the Promotion. Void where prohibited.
III. THREE WAYS TO ENTER SWEEPSTAKES:
1.) Online With Order:
• Go to Sponsor’s Website www.3dpapergreetings.com and enter requested company information.
• Place a minimum $100.00 order with 3D Paper Greetings during Promotion Period and you will be automatically entered into the Sweepstakes.
• You are allowed a maximum of one (1) entry per day, per P.O. number that accompanies a minimum $100.00 3D Paper Greeting Card order.
• All orders and entries must be completed by 11:59 pm EDT on November 25, 2009.
2.) Phone-In Order:
• Call 888-337-2737
• Place your minimum $100.00 order with 3D Paper Greetings/3D Paper Graphics during Promotion Period and you will be automatically entered into the Sweepstakes.
• You are allowed a maximum of one (1) entry per day, per P.O. number that accompanies a minimum $100.00 3D Paper Greeting/3D Paper Graphics order.
• All orders and entries must be completed by 11:59 pm EDT on November 25, 2009.
3.) Mail-In AMOE: Enter by hand printing on a 3" x 5" card, in black or blue ink, your Company’s name, first name, last name, 3D Paper Greetings’ Customer Account # (if available), email address (if available), mailing address, city, state, zip, business phone number with area code first. Mail the 3" x 5" card in a hand printed first class stamped envelope to: “Ultimate Business Greeting Card Sweepstakes”, 90 Rockwood Place, Rochester, NY 14610.
• All entries must be postmarked by November 24, 2009 and received by November 30, 2009.
• Each properly completed and received card will receive one entry into the Sweepstakes drawing. Limit one per day.
• Typed, computer generated, or otherwise mechanically reproduced 3” x 5” cards, and outer envelopes are NOT allowed and will not be accepted. Sponsor reserves the right to disqualify any person or e-mail address that submits more than maximum allowed entries. Proof of sending a submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for mail that is lost, late, incomplete, invalid, unintelligible, illegible, stolen, damage, or misdirected. Postage due mail entries will be disqualified. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.
IV. LIMITATIONS AND LIABILITIES: If for any reason this Sweepstakes is not capable of running as planned due to failure or incapacity by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor, that corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole and absolute discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of or after (if applicable) this termination or suspension date. Sweepstakes Entities and Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sweepstakes Entities and Sponsor are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials for this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning
email addresses for the domain associated with the submitted e-mail address.
V. PRIZES:
• One (1) Grand Prize Winner to be awarded an Apple MacBook Model MC240LL/A
Approximate Retail Value (“ARV”) $999.00
• One (1) First Prize winner to be awarded an Apple iPod touch Model MB528LL/A
“ARV” $229.00.
• One (1) Second Prize winner to be awarded an Apple iPod shuffle Model MC164LL/A “ARV” $79.00
Total “ARV” of Prize Pool is $1,307.
In Addition: The Grand Prize winner will participate in a chance-based game to determine if he/she will win $25,000 Cash. The Grand Prize winner will be invited to select and remove two (2) envelopes from fifteen (15) sealed envelopes. Two of these 15 envelopes contain a certificate for the $25,000. The winner must select both winning envelopes. The winning envelope(s) will be revealed if not selected by the winner.
Total Prize Pool “ARV” is $26,307.
Odds of winning in any drawing depend upon the number of entries received by the time of that drawing. Sponsor reserves the right, at its sole discretion, to substitute any prize package with another prize of equal or greater value in the event that the advertised prize (or any component thereof) is not available. All decisions by Sponsor as to prizewinners and prizes are final.
VI. DRAWING NOTIFICATION AND AFFIDAVIT RELEASES: The potential Three (3) winners will be selected from among all eligible entries received, in a random drawing conducted on or about December 7, 2009, by Compliance Sweepstakes Services LLC, a third party administrator (“the Administrator”) an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. Potential winners will be notified by phone and/or email. Upon initial notification and verification of potential winners, confirmation will be sent to winners in writing via email, USPS mail, or other business delivery service of Sponsor’s choice. Potential prize winner will be required to sign and return an Affidavit of Eligibility and Liability Release ("Affidavit") within ten (10) days of the initial attempted of prize winner notification (as indicated by the date referenced in the Affidavit) sent to the postal address associated with the entry registration. Failure to return the Affidavit within the ten (10) days, as stated in the Affidavit, may result in Prize forfeiture, and an alternate winner may be selected. Any mail (whether USPS or e-mail) returned as undeliverable without a forwarding address might result in prize forfeiture and an alternate winner may be selected at Sponsor's sole discretion. Allow 4 to 6 weeks for shipment of a prize by mail following notification process. Prize will only be delivered to addresses within the United States. Sponsor assumes no responsibility for any prize after it has been shipped.
VII. PRIZE CONDITIONS: No substitution of prizes is offered, no transfer of prizes to a third party is permitted and non-cash prizes are not redeemable for cash value, except as determined by Sponsor in its sole discretion. Sponsor reserves the right to award a prize of equal or greater value in the event the published prizes become unavailable. Any difference between the stated value of a prize and the actual value of prize will not be awarded. All federal, state and local laws and regulations apply. Prize recipients are responsible for all applicable federal, state, and local taxes on a prize; if applicable, Grand Prize Winner will receive a Form W-9 and/or an IRS Form 1099 for the retail value of the prize. Upon forfeiture for any reason stated in these Official Rules, no compensation will be given except at the sole discretion of sponsor. A Participant is not eligible to receive a prize until his/her entry has been selected as a potential winner in the Sweepstakes, and he/she has been verified in accordance with these Official Rules, and he/she has fully complied with these Official Rules. Business must be in “current paid” standing in order to be awarded a prize. The winner’s entry and acceptance of the prize offered constitutes permission (except where prohibited by law) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
VIII. TERMS AND CONDITIONS: This Sweepstakes is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Entrants also consent to the use of the personal data they submit to be used solely by the Sponsor and affiliated partners for marketing purposes, statistical analysis, or customer relations. This information will never be sold or shared with third parties and all entrants will be given the opportunity to opt-out at any time. The Prize winner and all entrants also agree to release, discharge, indemnify and hold harmless the Release Parties and Sponsor for, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of prize offered, or participation in this Sweepstakes. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the full extent of the law. This Sweepstakes is void where prohibited.
IX. DISPUTES: This Promotion is governed by the laws of the United States and the State of Connecticut, without respect to conflict of law doctrines. As a condition of participating in this Promotion, you agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Middlesex County of Connecticut, having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (e.g. costs associated with entering), and participants further waive all rights to have damages multiplied or increased.
X. VT & WA residents may omit return postage.
